Terms & Conditions

For the sale of custom kitchen cabinetry, vanities, closets, and design services

These Terms govern all iKitchen Cabinetry sales. Payment of any amount constitutes acceptance.

iKitchen Cabinetry Inc. ("Company", "we", "us")

These Terms and Conditions ("Terms") govern the relationship and constitute the agreement between iKitchen Cabinetry Inc. ("Company", "we", "us") and the Customer ("you") for the purchase of custom kitchen cabinetry, vanities, walk-in closets, built-ins, and related design services.

1. Manufacturing & Materials

Our custom cabinetry is manufactured in Canada using premium materials sourced from North American suppliers. The Company selects materials at its discretion to comply with its quality standards. All cabinetry is built to order and produced exclusively for the specifications agreed in the customer's final approved plans.

2. Design Services & Design Retainer

Customers seeking design services are required to pay a non-refundable Design Retainer. Design Retainers start at $3,000 USD and may be higher depending on project scope, complexity, room count, and design hours required.

The Design Retainer covers:

  • Computer-Aided Design (CAD) drawings and floor plans
  • Professional consultation and design hours with an iKitchen designer
  • 3D renderings of the proposed finished space, including materials, colors, and finishes
  • Up to a defined number of design revisions, as specified in the design agreement

The Design Retainer is fully earned upon payment and is not refundable under any circumstances, regardless of whether the customer proceeds to order cabinetry from the Company.

3. Scope of Quotation

Quotations for cabinetry include only the custom cabinets as per the specifications in the approved design. Unless expressly stated in writing in the quotation, quotations do not include:

  • Countertops and stone fabrication
  • Hardware (handles, knobs, pulls), unless specified
  • Appliances
  • Electrical materials, fixtures, or labor
  • Plumbing fixtures or labor
  • Demolition or site preparation
  • Drywall, paint, tile, flooring
  • Installation labor
  • Delivery beyond curbside (white-glove and inside-the-home delivery may be quoted separately)
  • Permitting or inspection fees

4. Pricing & Revisions

Pricing is based on the most recently approved set of plans and finish selections. Any revisions, changes to plans, changes to measurements, changes to materials or finishes, or changes to scope after the quote has been provided may result in a modification of pricing and lead time, and may incur additional design hours billed at the Company's standard rate.

All prices become final upon written acceptance of the quote by the customer and receipt of the Production Deposit.

5. Changes to Plans, Measurements, and Specifications

The customer is responsible for verifying the accuracy of all plans, measurements, dimensions, finish selections, hardware selections, and door styles before approving the final design. Customer approval of plans — whether signed, emailed, or made by payment of any deposit — constitutes acceptance of those plans as complete and correct.

Once the Production Deposit has been received and production has commenced:

  • Changes to plans, measurements, finishes, or specifications may be impossible to accommodate
  • Where changes can be accommodated, they will be billed at the Company's standard change-order rate and may extend lead time
  • Changes may require additional non-refundable deposits before work begins

The customer agrees that any measurement errors, dimensional mistakes, or specification errors that originate from plans approved by the customer are the customer's responsibility, and the Company is not liable for resulting rework, replacement, or refund.

6. Acceptance of Terms Through Payment

The customer acknowledges and agrees that the payment of any amount to iKitchen Cabinetry Inc. — including but not limited to a Design Retainer, Production Deposit, progress payment, balance payment, change-order fee, storage fee, or delivery fee — constitutes acceptance of:

(a) These Terms and Conditions in their entirety;
(b) The most recently approved set of plans, measurements, and specifications;
(c) The associated quotation, including pricing and lead time;
(d) The Company's Privacy Policy.

By making any payment, the customer confirms that they have read, understood, and agreed to be bound by all the terms set forth herein, and that the plans, measurements, and specifications associated with that payment have been reviewed and approved.

7. Terms of Payment

The customer agrees to the following payment structure for all orders:

a. Design Retainer: Starts at $3,000 USD, due before design work commences. Non-refundable.

b. Production Deposit: 50% of the total order value, due before production begins. Production will not commence until this payment is received and processed in full. Non-refundable once production has begun.

c. Balance Payment: The remaining 50% of the total order value is due before delivery is scheduled. Delivery will not be scheduled or executed until the outstanding balance is paid in full.

d. Change-Order Payments: Additional payments associated with changes, additions, or scope adjustments are due at the time the change is approved by the customer. Non-refundable.

e. Storage Fees: If the finished cabinetry is not received by the customer upon completion, storage fees will be invoiced separately (see Section 13).

8. Non-Refundable Deposits and Payments

All deposits and payments made to iKitchen Cabinetry Inc. are non-refundable.

This includes, without limitation:

  • The Design Retainer (non-refundable upon payment)
  • The Production Deposit (non-refundable upon receipt or once production has commenced, whichever occurs first)
  • Any Balance Payment, change-order payment, storage fee, or progress payment

Because our cabinetry is custom-manufactured to the customer's specifications and cannot be resold, no refunds, returns, exchanges, or chargebacks will be accepted for any reason. The customer expressly waives any claims against iKitchen Cabinetry Inc. for reimbursement, refund, or chargeback of any payment made under these Terms.

9. Lifetime Warranty

Our custom cabinetry comes with a Lifetime Manufacturer's Warranty covering defects in materials and workmanship under normal residential use. This warranty:

  • Is non-transferable
  • Applies only to the original purchaser at the original installation address
  • Covers manufacturing defects only
  • Does NOT cover: damage caused by third parties; damage from improper installation by parties other than the Company; damage caused by accidents, misuse, abuse, or negligence; natural disasters; water damage; damage from temperature or humidity extremes outside normal residential conditions; cosmetic variations in wood grain, color, or finish (see Sections 14–16); damage from normal wear and tear; or damage from modifications or alterations made by anyone other than the Company.

Warranty claims must be made in writing to the Company within thirty (30) days of the defect being discovered.

10. Limitation of Liability

The Company's liability under this agreement is strictly limited to the replacement, at the Company's sole discretion, of defective cabinetry components under warranty. The Company will not be liable for any indirect, special, incidental, consequential, exemplary, or punitive damages, including but not limited to lost income, lost profits, loss of use, loss of business opportunity, or damages to other property in the customer's residence.

In no event shall the Company's total liability to the customer exceed the amount paid by the customer to the Company for the specific cabinetry that is the subject of the claim.

11. Installation and Third-Party Services

iKitchen Cabinetry Inc. is not responsible for the installation of the cabinets, nor for any third-party services including but not limited to: countertop fabrication and installation, plumbing, electrical, demolition, drywall, paint, tile, flooring, appliance installation, or general contracting.

When the Company refers the customer to a third party (installer, contractor, fabricator, etc.), such referral is provided as a courtesy only. The Company is not the employer, agent, or partner of any third party. Any agreement reached between the customer and a third party is solely between those parties, and the Company is not liable for the performance, quality, timeliness, or conduct of any third party.

12. Production Time

The estimated production time for custom cabinetry is approximately 8–12 weeks from receipt of the Production Deposit and finalized approved plans, depending on materials, finishes, and project complexity. This estimate is provided in good faith and may be revised due to:

  • Material availability and supply-chain conditions
  • Customer-requested changes
  • Customer delays in approving plans, finishes, or measurements
  • Force majeure events (see Section 19)

The Company will use commercially reasonable efforts to meet estimated timelines but does not guarantee specific delivery dates unless expressly stated in writing.

13. Storage of Completed Products

If the finished cabinetry cannot be delivered upon completion of production due to customer-related delays (site not ready, customer unavailable, etc.), the cabinetry will be stored at a facility chosen by the Company at the customer's expense.

Storage fees will be billed monthly and must be paid in full before the products can be released for delivery. Storage fees are non-refundable.

The Company is not liable for damage, theft, fire, water, or other loss occurring during storage beyond what is covered by the Company's customary insurance.

14. Variation in Finishes and Materials

The customer acknowledges and agrees that the Company does not guarantee exact uniformity of finishes. Natural materials such as wood may vary in grain pattern, color, tone, knotting, and staining due to their inherent natural characteristics. Stone may vary in veining and color. Painted and stained finishes may vary slightly between batches.

The Company relies on its suppliers for materials and, while every effort is made to ensure consistency with the approved samples, variations may occur and are not considered defects.

15. Variation in Appearance Post-Installation

The customer acknowledges that the appearance of finished products once installed may vary from showroom samples or 3D renderings due to factors including but not limited to: ambient temperature, humidity, natural and artificial lighting conditions, exposure to direct sunlight, surrounding finishes, and the customer's home environment. These factors may affect the perception of color, finish, sheen, and tone. The customer accepts these inherent factors.

16. Variation in Appearance Over Time

The customer acknowledges that the appearance of finished products may evolve over time after installation due to natural aging, temperature and humidity cycles, sunlight exposure, and ordinary use. Wood may patina, lighten, or darken. Painted and lacquered finishes may show minor wear at high-touch areas. Stone may etch or patina. The customer accepts these as normal characteristics of natural materials, not defects.

17. Customer Responsibilities

The customer is responsible for:

  • Providing accurate site measurements at the time of design, or arranging for the Company to take measurements when offered
  • Reviewing and approving all plans, dimensions, finish selections, hardware selections, and pricing prior to making any payment
  • Ensuring the site is ready for delivery and installation (clean, accessible, structurally sound, level floors, proper utility connections)
  • Coordinating any third-party trades (plumbers, electricians, installers, painters)
  • Obtaining any necessary permits or inspections
  • Promptly inspecting cabinetry upon delivery and reporting any visible damage in writing within 48 hours of delivery
  • Promptly paying invoices in accordance with these Terms

18. Inspection and Acceptance Upon Delivery

The customer must inspect cabinetry upon delivery and note any visible damage on the delivery receipt. Damage claims not noted on the delivery receipt and reported in writing to the Company within forty-eight (48) hours of delivery will be deemed waived.

Concealed damage discovered after installation must be reported in writing within seven (7) days of discovery.

19. Force Majeure

The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, fire, flood, pandemic, epidemic, war, civil unrest, governmental action, labor disputes, supply-chain disruptions, transportation delays, raw material shortages, or factory shutdowns.

20. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the state or province in which the iKitchen Cabinetry showroom that originated the customer's order is located, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the courts located within that state or province for any disputes arising from or relating to these Terms.

21. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

22. Entire Agreement

These Terms, together with the customer's approved plans, the quotation, any signed design agreement, any change orders, and any addenda or amendments, constitute the entire agreement between the parties regarding their subject matter and supersede all prior or contemporaneous agreements, understandings, representations, or marketing materials.

23. Amendments

The Company may amend these Terms from time to time. The current version is always available at https://www.ikitchen.shop/legal/terms-and-conditions.html. The version in effect at the time of the customer's most recent payment governs the customer's order.
